Courtroom Participants Professional Standards Essay

For the purpose of this paper I will be discussing the questions posed in the course syllabus by my professor: * Prosecutorial Misconduct   * Prosecutorial misconduct is best described as illegal acts utilized by a prosecutor to persuade a jury to wrongly convict an individual accused of a crime or securing a severe sentence that may not be justified towards the actual crime. Often times there are occurrences of individuals that are wrongfully convicted, many of these individuals are incarcerated for extended periods of time before their cases are even heard or brought before a jury. * Ineffective assistance by criminal counsel An attorney providing ineffective assistance can be considered as those occurrences when the service provided by an attorney to a defendant proves to be ineffective and in doing so, would be a violation of the Sixth Amendment of the Constitution. Ineffective assistance of counsel is defined in the Supreme Court’s ruling surrounding the landmark case of Strickland v. Washington (1984). In order for a defendant to prove ineffective assistance, the individual would first have to provide proof that demonstrates that his counsel’s performance was inefficient due to the attorney make a large number of errors. Secondly, the defendant must demonstrate that the attorney’s errors directly impacted the defendant’s case prejudicially. In this instance prejudice takes on the meaning of†¦.the trial would have resulted in a different outcome it not for the fact of the attorney’s errors resulting in the sentencing be affected. * Judicial misconduct Judicial misconduct refers to the judge’s conduct and the fact that they are constantly in the view of the public, so they are held to a higher standard in the area of respecting the individuals they interact with on a daily basis as well as all defendants that appear before them in court. * Real life stories My real life story on prosecutorial misconduct focuses on the case of Raymond Towler, who was convicted on the charge of rape of an eleven year old girl and completed 30 years of a sentenced life sentence trying to convince the courts of his innocence. Assistant District Attorney Bill Mason motto of â€Å"win no matter what† resulted in him eliciting testimony that he knew, or had been advised was in accurate. Mason interviewed a police detective who stated in court that Towler never denied raping the eleven year old; however, notes written by the detective himself during his investigation supported Towler’s claims to not having raped the child. In responding to Mason’s questions, a police officer provided testimony that Towler had some form of an indecent communication with the child prior to the rape. Yet police records indicated that it was Chris Towler, Raymond’s brother, who had communication (which was appropriate) with the child. Even with a variety of inconsistencies present, a misled jury still convicted Towler. The mistake the prosecutor made was that he did not utilize sufficient evidence in the case or the fact that Towler wasn’t nowhere near the area or the fact that he never even came in contact with the child, physically or verbally. He also failed to utilize the statement taken by the officer concerning to it being Towler’s brother that was in the area where the act supposedly occurred and had the documented conversation with the child. Without these little pieces of evidence being presented Towler was sentence to life in prison and had spent 30 years incarcerated. How do you replace the time that individual lost? What form of immunity provides protection to the prosecutor pertaining to consequences of misconduct? By the guidelines set forth in the legal dictionary â€Å"Prosecutors are afforded totally immunity for any actions committed before a Grand Jury or a trial. However, while conducting the investigatory phase, only qualified immunity is granted to them. In the case of Kalina v. Fletcher, (1997), it was ruled by the United States Supreme Court that absolute immunity was not a right entitled to prosecutor in regards to his/her actions of allegedly submitting false statements of facts in an Affidavit supporting the application document for an arrest warrant. Consideration of policies regarding merited absolute immunity contains interest of both protection of the prosecutor of harassing litigation that would disrupt the required time or the attention allocated for official duties and the interest towards providing him/her the ability to utilize independent judgment pertaining to decisions on which suits to file and pursue in court. Another example of a real life story pertaining to judicial misconduct would be the case involving Samuel Kent, Mr. Kent served as a judge for over 18 years, but was now being sentenced to three years inside a federal prison for lying about inappropriate conduct towards his staff, of which two provided physic al evidence as to number of years they both endured various assaults by the judge who was for the most part intoxicated. The pattern of sexual misconduct directed at the judges co-workers along with constant violations of workplace intoxication are obvious wrongdoings committed by the judge. It is my opinion that performing elections would be better suited process for judicial selection due to its ability to allow the citizens to make their own choice as to who should represent them through the process of researching them first. While certainly recognizing these acts of misconducts occurring within our criminal justice system, how we propose deter criminal acts on the streets when it’s evident we can not deter it inside of our courts and legal system. Then when you factor in the occurrences of individuals being incarcerated and then being found innocent and having to be compensated through local and state funds that we other citizens are responsible for not to mention the lost of time these individuals lose from their life, friends, and family; which honestly begs the question how could any amount of money replace this time. In my opinion, we as a society really need to make ourselves more aware to the fact that these issues require addressing in our criminal justice system. We really need the accessibility of additional resources required to fill more jobs with truly qualified individuals versus our penchant for sacrificing ourselves to individuals with recognizable names or higher government officials who claim to have or best interest at heart when certain decisions they make appear to be the complete opposite. Environmental Effects on Fetus Essay

We count all toes and fingers when children are born. We try to make sure that children are born healthy and try to do our best of making sure they stay that way until they are adults. However, sleeper effects are aspects that affect fetuses when born or later on in life. One agent in the environment that can adversely disturb an unborn child is teratogen. Most fetuses are exposed to at least one teratogen (motorized or physical instruments, environmental substances, communicable agents) (Palenchar, 2005). Fetuses can also be affected by an individual’s age, fitness, nourishment, and genetics. Communicable diseases can cause irreversible damages to fetuses. These diseases can disturb the fetus while still in the womb or through the birth canal or sometimes both. For instance, if a mother is in her first trimester and has rubella, the child may be have heart defects, be blind or even metal retarded. If the disease is still present in the second trimester, the child may have language issues, hearing and vision loss (Sleigh, 2005). Another example would be if the mother has AIDs. During birth, the child may be infected. This is because infants are susceptible to respiratory illnesses (Sleigh, 2005). Prenatal care is vital to the prevention of many illnesses for the child and mother. If the mother is not receiving proper nutrition, then the womb is not able to pass nutrients on to the fetus and it will not develop properly. The offspring of this fetus will be affected and the generation after, therefore fetuses can be affected multigenerational (Sleigh, 2005). Finally, Sleigh (2005) says that the ideal time for women to have children would be in their 20’s. This is because mental disabilities can show up in children whose mother gave birth to them past the age of 35. Hormonal changes due to a woman approaching menopause may cause the uterus to be less favorable for fertilization. Additionally, the mother’s overall health is a risk as she may develop high blood pressure or gestational diabetes. Adolescents are still growing and developing themselves and having a child at such a young age will cause malnutrition, premature delivery, and the mother may develop osteoporosis. A women’s overall health is important when considering having a child. There are several factors that can affect the fetus in the womb and after. With the proper guidance and nutrition, the fetus will have a good chance of having a healthy life.

Among the Japanese, bowing when greeting someone is considered to be a moral practice. This forces foreigners to forego their practices and adopt those of the locals. In Muslim countries, women have to veil their faces before appearing in public, and their hair should be covered always. Several societies consider keeping long hair and beard to be immoral. Customs upheld by communities define the right and wrong practices, which at times can be oppressive. In such cases, customs are considered to be the baseline of moral beliefs in the society. In Germany, the Nazis were against the Jewish religion and the leaders decided to execute them (6). According to Nazis, this was the accepted way of eliminating the Jews, but was considered to be evil by the Americans due to different customs. Individual values are gotten from parents, teachers, religious leaders, and historical books. Children internalize values learnt from different sources and form a sense of good or bad. This leads to the differences in moral values between different cultures. Ancient customs or cultures have different moral values, which are learnt by the children and subsequent generations. The conscience of a human being is also a product of the moral life. Conscience helps individuals identify wrong acts depending on personal and society values contributed to by culture. An individual picks up several values during childhood and along his or her lifetime that give the definition of a good human being (7). Cer tain individuals may adapt different values from other people within the same community due to external influence. In Germany, some Nazis rebelled, held out, and fled from the mass execution of Jews by Hitler. According to them, execution was immoral though it was being practiced by their fellow Nazis. Moral values can be influenced by external cultures and one’s own values cease to be superior to that of others. The society defines the morally acceptable values, but individuals may change their values depending on the influence. However, every individual or society believes to hold the highest values irrespective of their nature. Holding certain values does not mean they are the overall good, but they influence a person’s view of the right and wrong practices. This makes moral values to be relative to the society and the upbringing of an individual (9). The religion also determines the values regarded by an individual as good or bad. Some people believe that God revea ls the truth to human beings, which also defines the good and the bad. This forces them to line up their values according to the religious revelations and form a point of judging others. This makes them believe their values to be absolutely right and can act as the standard goodness. Some individuals do not believe in Godly revelations, therefore, their values are based on culture (11). Different objective points provide different justifications of moral assessments.

Young people who enter the labor force and searching for jobs are an important source of frictional unemployment (Chrystal, 2004, p. 600). Also people who are planning to switch their present job are a source of frictional unemployment. Some people leave a job because of job-dissatisfaction and others are terminated. Structural unemployment occurs because structural adjustments can cause unemployment (Chrystal, 2004). Since the demand for labor is a derived demand, when the demand for product changes, the demand for labor also changes. If labor does not adjust as per the changing product demand, there is structural unemployment. Cyclical unemployment best describes the rising unemployment in the UK. Since UK is in the recessionary period of the business cycle, it means there is low economic activity and also there is less demand for the countryà ¢â‚¬â„¢s output. Hysteresis is a Greek word which means ‘coming late’ and in economics, it means that the current equilibrium is not independent of what has gone before- it is path dependent (Chrystal, 2004, p. 601). The â€Å"fallen lance† is â€Å"He,† the soldier. â€Å"Lies unlifted† tells the reader that the soldier is dead, not uplifted as the reader would expect to have read rather than the word â€Å"unlifted. The lance, which is the soldier, will wither away just as a lance left in the ground would rust away. Then Frost tells his readers that society doesn't see the soldier's life important enough to have solved anything, and that the soldier's death didn't hav e any meaning. Before Frost tells his readers this, he first gives a hint that the soldier's death did have meaning. But still lies pointed as it ploughed the dust. The soldier though, â€Å"tripped† and â€Å"shot the sprit on,† depicting that he is in a better place now. And the soldier is now at peace. Robert Frost used rhyme to keep the reader's interest, and implemented it very cleverly into his poem. The last word in the first line of his poem rhymes with the last word of the fourth line.And the last word of the very next line rhymes with the last word of the eighth line, which is the same interval of lines between the first and fourth lines. This pattern continues throughout the poem, and the lines that are in the middle of these intervals, also have their last words rhyming with each other. In conclusion, Robert Frost paints an image of a passed soldier that many may have been forgotten.
